    New Zealand lawyers have condemned a move that apparently fooled a NZ District Court by falsely prosecuting an undercover policeman to boost his status within a criminal motor cycle gang.
    Police have defended the move because of the dangerous nature of undercover work, but a leading NZ barrister has castigated the decision and claimed it was an "abuse of process hitherto unknown" in the legal system in this country.
    Documents show the fake prosecution was signed off in 2010 by Chief District Court Judge Russell Johnson, who has since deceased. A police letter to Judge Johnson obtained by a New Zealand Sunday newspaper, stated that an undercover officer had infiltrated the Nelson based Red Devils motorcycle gang, to protect his assumed identity and to ensure his continued safety, divert suspicion, and enhance his continued safety and enhance the appearance of criminality.
    The Red Devils are a chapter of the British based Red Devils motorcycle gang which has chapters in a number of countries, and is affiliated to the international Hells Angels - a proven criminal organisation which includes many murders in its history.
    It is a dangerous precedent made in the New Zealand legal system, to have a 'false prosecution' processed through the Courts. Surely, if the undercover officer was in any danger he should have been withdrawn for his own safety, regardless of the investigation being undertaken. The Minister for Courts,Chester Borrows, could not make any comment before this story was published. But I'm certain there will be some strong reaction to these allegations of an outrageous "sham" prosecution. For a government on the backfoot since the release of its budget last week this controversy is needed like the proverbial hole in the head.
